The Jennifer L Zannini Cipriani Foundation (the “Foundation”) website and the Foundation’s mobile application (collectively, the “Site”) are intended for use by individuals (non-professionals) for non-commercial, personal purposes.  By choosing to use the Site you acknowledge and agree to these Terms of Use and the Privacy Policy below. The Foundation reserves the right to modify these Terms of Use and the Privacy Policy, and we recommend that you periodically review this page of our Site to make sure you are aware of any changes that affect you.

Information and Support – Not Medical Advice

The information and resources on the Site are intended to provide information and support to individuals, but not to provide medical advice.  The Foundation is not a health care provider or an insurance company, and we are not affiliated with any provider or insurance company. Individuals should consult their health care providers for all diagnosis, treatment, and answers to personal health care questions; and they should consult their insurers for all health insurance questions. 

Appropriate Use of the Site

The Site and all original content and features are protected by copyright and other intellectual property laws. Unless otherwise stated, you may print or download information from the Site for personal, non-commercial use only, provided you identify the source of the material and include a statement that the materials are protected by copyright law. Reprinting or otherwise reproducing any content, in whole or in part, is prohibited unless prior written consent is obtained from the Foundation.  You may not use the Site for any illegal or unauthorized purpose.

The information and resources found on the Site do not necessarily reflect the views of Foundation.  The Foundation does not endorse the information or resources and cannot guarantee their accuracy.  Your transactions and/or communications with any resource that is referenced on the Site and any conditions, warranties or representations associated with your transactions or communications, are solely between you and that resource. The Foundation is not responsible for any injury or loss incurred in connection with such transactions or communications.

The Site contains links to websites operated by parties other than the Foundation. These links are provided for reference only.  The Foundation does not control these websites and is not responsible for their contents or their privacy policies or practices. Our inclusion of links to other websites does not imply our endorsement of the material on the websites or any association with their operators.

The Site is provided on an “as is” and “as available” basis.  We make no representations or warranties that service will be uninterrupted or error-free, or that the Site or server that makes it available are free from viruses, worms, or other harmful components.

Limitation of Liability; Indemnity

Neither the Foundation nor anyone involved in the creation, production, or delivery of the Site will be liable for any claim, liability, loss, or expense of any kind, or for any direct, indirect, punitive, incidental, special or consequential damages (collectively, “Loss”) arising out of or relating to these Terms of Use and Privacy Policy or use of the Site. You agree to make the Foundation whole for any Loss arising from your use of the Site or any violation of these Terms of Use and/or Privacy Policy.

Governing Law; Severability

These Terms of Use and Privacy Policy are governed by and construed in accordance with the laws of Massachusetts, except with regard to its conflicts and choice of law rules. You agree to submit to the personal and exclusive jurisdiction of the courts located in Boston, Massachusetts.  If, for any reason, a court of competent jurisdiction finds any provision of these Terms of Use and Privacy Policy to be unenforceable, the remainder of these Terms of Use and Privacy Policy will continue in full force and effect.Personal Data

The Foundation is committed to protecting your privacy when you visit our Site.  This Privacy Policy explains the type of information we may collect from you, and how we use it and safeguard it.  By using the Site, you agree to the terms of this Privacy Policy.  We reserve the right to modify it at any time, and your continued use of our Site indicates your acceptance of any modifications.

Personal Data We Obtain from You

If you knowingly provide identifiable information to us by signing up for our newsletter, we will use the information for the purpose for which it was collected.  If you contact us to provide feedback or to ask a question, we record your personal information and the content of your communication so that we can respond to you effectively.  We may also use this information to send you information about the Foundation or to contact you when necessary. 

Personal Data We Obtain from Third Party Sources

We may obtain certain personal data about you from third party service providers and payment processors, such as PayPal, who perform services on our behalf.  Some of these providers have access to personal data about you that we may not otherwise have (for example, when you sign up directly with that provider) and may share some or all these data with us.   

Additional Uses of Personal Data

In addition to using your personal data as described above, we may use your personal (a) to prevent, investigate, take action regarding or provide notice of security or technical issues, unauthorized access to or use of personal data, or unlawful or criminal activity or misconduct; or (b) to respond to court orders or other legal process and meet legal obligations.

Data Retention and Security

We will retain your personal data for as long as necessary for the purposes set out in this policy unless a longer period is required under applicable law, or is needed to resolve disputes or protect our legal rights or otherwise to comply with legal obligations.  The Foundation uses commercially reasonable precautions to protect the security of your personal information using industry standard measures of protection, but absolute security cannot be guaranteed.  It is up to you to protect against unauthorized access to your computer. The Foundation is not liable for the transfer of any personal information resulting from corruption of storage media, power failures, riots, acts of vandalism, sabotage, or any other event beyond our reasonable control.

Non-Personal Information

When users visit the Site, we automatically collect non-personal information about their use of the Site such as their browser type, requested URLs, times accessing the Site, and pages visited.  We do this through the use of “cookies”—small data files that are stored on the hard drive of a computer to view a website.  This data, which is used in the aggregate and cannot be used to identify or contact users, may be used for analytic purposes—for example, to monitor the effectiveness of the Site, make improvements, and learn which topics are of greatest interest to users.  Most browsers offer instructions on how to reset the browser to reject cookies in the “Help” section of the toolbar. If you do not accept our cookies, certain functions of the Site may not work properly, but you do not have to accept our cookies in order to use the Site.
